The FCRA is the federal law that governs the background screening industry, including background checks, also called “consumer reports,” and background check companies, also called “consumer reporting agencies.” Among other obligations, under the FCRA, employers must:

    1. make a clear and conspicuous written disclosure to the applicant informing them that a background check may be conducted
    2. receive written consent from the individual for the employer to receive the background check report
    3. provide the individual with a “pre-adverse action” letter, along with a copy of the report and the Consumer Financial Protection Bureau’s Summary of Rights and give the applicant sufficient time to review and/or dispute the findings, prior to taking any action such as rescinding the employment offer or terminating employment
    4. provide the individual with an “adverse action” letter with specific language, as mandated by the FCRA, when the employer is ready to take the adverse action (mentioned above)
